1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the website at https://myfrontyardhoa.com (the "Site"), operated by My Front Yard ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms apply to the marketing Site only. Your use of our HOA management platform, if you subscribe to it, is governed by a separate agreement and is not covered by these Terms.

2. Eligibility

The Site is intended for businesses, HOA boards, property managers, and other adults. By using the Site, you represent that you are at least 18 years old and able to enter into a binding agreement.

3. The Site is informational

The Site provides marketing and informational content about our products and services, including videos and demonstrations. Content on the Site is provided for general information only and does not constitute legal, financial, accounting, or professional advice regarding HOA governance or any other matter. You should consult a qualified professional before acting on any information found on the Site.

4. Intellectual property

The Site and all of its content — including text, graphics, logos, images, videos, software, and design — are owned by or licensed to My Front Yard and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business evaluation purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.

5. Acceptable use

You agree not to:

  • Use the Site in any way that violates applicable law or these Terms;
  • Attempt to gain unauthorized access to the Site, its servers, or related systems;
  • Interfere with or disrupt the Site, including by introducing malware or excessive automated requests (e.g., scraping or bots);
  • Use the Site to infringe the rights of others or to transmit unlawful, harmful, or misleading content; or
  • Remove, obscure, or alter any proprietary notices.

6. Your submissions

If you submit information through the Site — for example, a contact or demo-request form, or feedback — you represent that the information is accurate and that you have the right to provide it. You grant us a non-exclusive, royalty-free, worldwide license to use feedback and suggestions you provide to improve our products and services, without obligation to you. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, My Front Yard AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless My Front Yard and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of the State of FLORIDA, without regard to its conflict-of-laws rules. Subject to Section 13, you agree that any dispute will be brought exclusively in the state or federal courts located in FLORIDA, and you consent to their jurisdiction.

13. Dispute resolution (optional — review with counsel before keeping)

Any dispute arising out of or relating to these Terms or the Site will be resolved through binding arbitration administered under the rules of a recognized arbitration provider, on an individual basis. You and My Front Yard waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by notifying us in writing within 30 days of first accepting these Terms.

Remove this entire section if you do not want a binding arbitration / class-action waiver; if you keep it, have an attorney confirm it is enforceable and properly disclosed.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including if we believe you have violated these Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site.
